Risk Of Loss
All customers upon agreeing to these terms and conditions accept that the risk of loss and title for any item pass to them upon our delivery to the courier. However the company will ensure all manner of reasonable measures are taken to minimize any such occurence.
Our Products
Although all due care has been taken by the company to ensure that product descriptions are accurate, the company does not claim that product descriptions or other contents are error free, current or otherwise. If a product offered b the company is not as described it should be returned to the company in its original state, including packaging and all components.
Security
The company takes all measures as far as is reasonably possible to ensure safe and secure facilities are in place to minimize the risk of loss to the customer whether as a result of fraud or otherwise. Notwithstanding this the company or its associates do not except liability for any loss or damages which may have occurred as a result of using the website, whether directly or indirectly. It is the sole responsibility of the customer to ensure the security of payment methods, such as credit card details. The company also accepts no liability of loss or damage as a result of emails or other online information containing viruses or otherwise. The customers understand that the use of this site is at their own risk. The company maintains their systems as far as is reasonably possible to minimize any such risk but does not claim or endorse that it is error free.
Delivery
The company will usually process an order the following working day of that which the order was received. We aim to ensure customers receive orders within 7 days, however this is not a guarentee.
The company will dispatch orders through one of the following methods at its discretion -
1 Internal Courier (local delivery only - generally within a 25mile remit)
2 External couriers- ParcelForce,InterLink Express, DHL or other such organisations
3 Royal mail standard/ recorded delivery (first and second class)
4 Royal mail couriers
International rates will vary. The company is not liable for any import taxes or other costs incurred by international buyers. International buyers are advised to contact the company prior toplacing orders as administration fees may be applicable.
Refunds And Returns
In the unlikely cases of faulty goods that are covered by manufacturers guarentee the customer should seek the advice of that manufacturer for refund or re-placment items.
If the wrong items have been purchased by mistake- customers must return the item/items in an unopened state to the address stated on the packaging/delivery note within 3 working days for a refund or credit note. We cannot refund after this time or if products are opened or without packaging or any components therein.
The company cannot refund any monies on certain articles which includes but is not restricted to - items of underwear, earings or other items of body jewellery, such as navel rings, eyebrow bars, studs, tongue bars etc. This is for health and hygiene reasons.
In the event of damage in transit occurring which is a direct result of the companies negligence or carelessness, such damages or faultys are subject to inspection by the company and must be returned to the company in their original state, complete with packaging and all components after informing the company either by email, telephone or in writing.
The company will not accept liability if the product is partial, with missing components, with missing or damaged packaging, has been modifiedor had attempted repairs carried out or if damage has occurred as a result of transportation or as a result of misuse or accidental damage of the recipient.
The company has a strict quality control system in place and all products are checked for faults and imperfections prior to any dispatching. Subsequently liability cannot be accepted for any damage in transit. This issue is then the responsibility of the customer and courier. (Unless in the instance of the company using internal couriers).
The company accepts no right of set off. If a product needs to be returned, the customer should follow our procedure. Email or write to the company, explaining what the problem is and informing us of the intnt to return. Please remember to include your invoice number and name.
Return the product - in its original state to the company address - the company will then inspect the product and inform you in due couse of the outcome.
If it is found that the product was damaged at the companies hands or as a direct result of negligence as afore mentioned, a refund or creditnote will be issued by the company to the customer to the value of the product - this excludes any postage and packaging incurred.
The company will not be liable for costs incurred by the customer on returning products or otherwise.
Any other disputes should be brought to the companies attention in writing or by email. All disputes should be addressed to the General Manager. In this instance the correct compaints form should be completed and returned to the company. Complaints forms are availale at anytime upon email request.
Upon accepting the contents of these terms and conditions the customer acknowledges and accepts that all disputes will be dealt with under English law.
Data Protection And Privacy
The company fully complies with industry standards and is SSL certified. It is also stringently audited by external bodies to ensure security levels are maintained.
Although the company operates a Data Protection Policy it cannot accept liability for any loss occurring as a result of using the website. The user/customer understands that using the site is at their own risk.
The company will eneavor to undertake all steps as far as is reasonably possible to ensure safe facilities to all customers and will not disclose any details including financial, details of purchases, personal details etc to any third party with exception to name and postal details to couriers.
The company regularly monitors the website and adheres to the requirements of the data protection act.
The company reserves the right to cnotact any customer regarding new products, promotions or otherwise unless the customer requests differently.
The company is fully registered with ICO.
Payments
From March 2010 the only payment method accepted is Paypal
We do not accept cheques, postal orders or bankers drafts. We do not accept cash payments for online purchases, and for security reasons, you should NEVER SEND CASH THROUGH THE POST.
Information Only
Associated companies and their security systems/products protect online card payments on behalf of both the customer and the company.
The company is also SSL certified and registered with ICO.
Additional Services
The company offers a FAST TRACK delivery service, where possible we aim to deliver the day after the order is processed. This is only available if orders are received before 12 noon. This can be added at the time of order. The company will charge an additional fee, whish is displayed at the order confirmation screen - each order differs dependant on weight and size.
We also offer a gift-wrapping service for an additional fee of £2.50, which can be purchased as above.
Drop shipping is available (delivery to another address). Please not this should be requested at the time of ordering to avoid disappointment. The service is free of charge.
Reserving of products or special orders can be catered for, the company will charge an additional fee and/or deposit, which will vary depending on the product. To use this service please email us.
It is generally accepted by most customers using this service that reserving deposits are 50% of the product price. The company reserves the right to retain the product until full payment is received and offer this service at their discretion.
The Company
The company reserves the right to request information from any customer at any given time. This may include but is not limited to proof of identity (as part of the companies security monitoring of the website). Proof of age (to ensure the company is complying with legal obligations regarding age restricted sales) which may include but is not limited to the sale of knives or bladed items, smoking related items, solvent based products and such like.
The company reserves the right to refuse sale to anyone for reasons including but not limited to -
1 Misuse of the website under the guidelines laid out by the company (policy documents available upon request).
2 If is suspects the customer to be under the legal age to purchase particular items governed by English law.
3 If it suspects fraudulent, dishonest or misleading conduct including but not limited to use of credit cards, personal identity, identity theft and/or incorrect personal details etc.
4 If it suspects that items purchased are to be used in a dangerous or threatening manner or for any other purpose other than that of its intended use. This may include but is not limited to knives, studded accessories or other.
5 If the company or any of its employees or associates feels at risk in anyway. Which includes but is not restricted to the use of threatening behaviour, abusive or obscene language, harassment or other. This includes eletronic mail, telephone or in person.
The company further reserves the right to permanently suspend anyone found in breech of this agreement or other policies laid out by the company. (All policies are available upon request)
The company offers no HP or credit. (We are not registered with relevent bodies and cannot negate on this)
The company reserves the right to ammend or remove any product listings at any time without notice. All products are subject to these terms and conditions and subject to availability.
